Raising the American Flag is a tradition that spread throughout American culture. From the Boyscouts to the Marines to major sports, Americans love paying homage to their flag. However, the First Amendment actually allows for desecration of the flag if it’s ‘free speech.’
Old Glory can even be burned without facing penalties, but one Texan is facing heat for refusing to remove his flag from his balcony. The reason why may shock you.
Duy Tran’s female apartment manger asked him to remove the American flag since it ‘offended’ members of the Muslim community. Tran has responded by promptly NOT removing the flag, choosing instead to practice his First Amendment right to display Old Glory. Even though his apartment complex has banned the flag, state and federal law rule in this situation. Tran had this to say about the injunction:
“It means a lot to me. I’m gonna leave my flag there, as an American, until she shows me proof that I don’t have the right to leave my flag there.” The Flag isn’t just a symbol of pride for Tran, it’s more than that. It’s a homage to his brothers that have died fighting for that very flag. It symbolizes the freedom all American’s enjoy that’s represented by the red white and blue.
Whether or not Tran is allowed to stay is still up in the air, but we feel sure there are plenty of apartment managers that would love to have a patriot like his live in their building.
